The Prospective Marriage Visa
Same–Sex couples can apply for a Prospective Marriage Visa where:
- the non-Australian partner lives overseas; and,
- the Australian partner sponsors the overseas non – Australian partner.
The Prospective Marriage Visa allows the overseas non-Australian partner to:
- enter and live in Australia;
- marry their Australian partner within the 9-month visa validity period; and,
- apply to live permanently in Australia by making a Partner Visa Application.
Main Requirements
- the Australian partner is an Australian citizen, Australian Permanent Resident or eligible New Zealand citizen who sponsors the overseas non Australian partner;
- the Same – Sex couple must have met, and, be known to each other personally;
- the Same – Sex couple genuinely intend to marry and live together as spouses; and,
- the overseas non Australian partner must enter Australia before marrying; and;
- meet sponsorship, age, health and character requirements.

STAGE 1
Prospective Marriage Visa Application
Stage 1 results in Prospective Marriage Visa approval for 9 months, during which the overseas non-Australian partner must:
STAGE 2
Partner Temporary Visa Application
The Same-Sex couple:
Stage 2 results in Partner Temporary Visa approval, pending a decision on the Partner Permanent Visa Application.
STAGE 3
Partner Permanent Residence Visa Application
The Same-Sex couple:
Stage 3 results in Partner Permanent Residence Visa approval.
